“We technically operate under the 2018 Farm Bill, so all of our products here are legally classified as hemp products,” Jesse Burns, General Manager of Bud City, said.
The law removes hemp, defined as cannabis, from the definition of the marijuana controlled substances act.
Burns said Bud City has been open in Fairborn for less than a month.
It’s why they handed out the flyers to nearby residents, hoping to spread the word that they are open for business.
People who got the advertisements reached out to News Center 7, concerned that marijuana was being sold illegally.
According to the CDC, the difference between hemp and marijuana lies in the amount of THC in them.
Hemp is defined as cannabis, containing .3% or less THC.
While marijuana contains more than .3% THC.
“There is a misconception, we don’t sell any Delta 8, no CBD products, a lot of these types of shops do sell some of those products,” Burns said. “But we strive to educate all of our customers and our clients.”
Burns said one day they hope to open a marijuana dispensary, but for now, they will continue building customers in Fairborn.
